Terms and conditions
These terms and conditions (“Terms”) apply when you use the services of Blackstar Interactive Ltd (“we”, “us”, “our”), a company based in the United Kingdom and trading as LaunchNow. They cover our website at launchnow.uk and the managed website subscription we provide to customers in the UK (and, where we agree in writing, elsewhere).
By contacting us, signing up online, or paying for our service, you agree to these Terms. If you do not agree, please do not use our services. Contracts may be formed in English and concluded electronically (email, online forms, or checkout).
1. About our service
We provide an all-in monthly website service aimed at small UK businesses. Unless we agree otherwise in writing, this typically includes custom website design and build, domain registration and renewal (including .uk domains where included in your plan), SSL, hosting and reasonable ongoing content updates as described on our website (currently advertised at £10 per month).
All prices are quoted in pounds sterling (GBP). Where VAT applies to your subscription, it will be shown at checkout or on your invoice in line with UK tax rules.
We aim to make new customer sites live quickly (often by the next business day) where you provide the information we need in time. Timelines are targets, not guarantees, and may vary with complexity, your responsiveness, or third-party delays (for example domain registration).
2. Your account and information
You agree to:
- provide accurate and complete information about you and your business;
- keep your contact details up to date;
- respond to reasonable requests for content, approvals, or access needed to deliver the service;
- ensure you have the right to any text, images, logos, and other materials you supply to us.
3. Acceptable use
You must not use our service to publish or promote content that is unlawful, misleading, defamatory, infringing, harmful, or otherwise objectionable. You must not use your site to distribute malware, send spam, or interfere with our systems or other customers.
We may suspend or remove content, or terminate service, if we reasonably believe these Terms or applicable law have been breached.
4. Your content and intellectual property
You retain ownership of content you provide (text, images, trade marks, and so on). You grant us a licence to use, host, copy, adapt, and display that content solely to provide and improve your website and related services.
We retain ownership of our pre-existing materials, tools, templates, code frameworks, and branding. Where we create bespoke design or code for your site, we grant you a licence to use it for your business website while your subscription is active. If your subscription ends, we will discuss handover or export options where practical; some underlying platform components may not be transferable.
5. Fees and payment
Fees are charged monthly in advance by card or another method we offer, unless we agree otherwise. Prices on our UK website apply unless we have confirmed a different rate in writing. We may change standard prices for new customers or after giving existing customers reasonable notice (for example by email or a notice on our website).
If payment fails or is overdue, we may pause hosting, withhold updates, or end the service after giving you notice where appropriate. You remain responsible for any bank or card charges your provider applies.
5a. If you are a consumer
Most of our customers are businesses, but if you are an individual and you are not acting wholly or mainly for business purposes, you may have additional rights under UK consumer law (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013).
- Statutory rights. Nothing in these Terms affects your statutory rights as a consumer, including that digital services must be performed with reasonable skill and care and be as described.
- 14-day cancellation (distance contracts). If you sign up online at a distance, you may have 14 days to cancel without giving a reason. If you ask us to start work immediately (for example to put your site live straight away), you may lose the right to cancel once the service has been fully performed, or you may owe a proportionate amount for work already done — we will explain this at signup where it applies.
- Unfair terms. If any term is unfair under consumer law, it will not bind you; the rest of the agreement remains in force where permitted.
Business customers contracting wholly for business purposes are not consumers for these purposes, but the service standards above still reflect how we operate.
6. Cancellation
You may cancel your subscription at any time unless a separate written agreement says otherwise. Cancellation takes effect at the end of the current paid billing period unless we agree an earlier date.
After cancellation, we may take your site offline. Domain names registered on your behalf may be allowed to lapse or transferred in accordance with our instructions and registrar rules. You are responsible for backing up any content you need if you leave the service.
7. Domains and third-party services
Domain names (including registrations through Nominet for .uk names), hosting, email routing, and SSL depend on third-party providers and registry rules. Their terms and availability also apply. We are not responsible for outages, policy changes, or failures caused by those providers, but we will use reasonable efforts to resolve issues within our control.
8. Updates and support
“Ongoing updates” means minor content and design adjustments included in your plan (for example text changes, image swaps, or small layout tweaks), not unlimited redevelopment, new applications, e-commerce builds, or major rebrands unless separately quoted.
Support is provided by email during normal business hours. We do not guarantee immediate response times but aim to reply within one business day for standard requests.
9. Warranties and disclaimers
We provide the service with reasonable skill and care, consistent with UK law and any applicable consumer standards. Except as required by law, we do not warrant that your site will be uninterrupted, error-free, ranked in search engines, or suitable for every purpose. You are responsible for checking that your published content complies with UK law and any industry rules that apply to your business (for example advertising standards or sector regulation).
10. Limitation of liability
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Subject to that, we are not liable for loss of profits, revenue, goodwill, data, or indirect or consequential loss. Our total liability arising from any contract with you in any twelve-month period is limited to the fees you paid us in that period, except where a higher limit is required by law.
11. Indemnity
You will indemnify us against claims, losses, and costs arising from content you supply, your breach of these Terms, or your unlawful use of the service, except to the extent caused by our negligence or breach.
12. Privacy
Our use of personal information is described in our privacy policy.
13. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “last updated” date. Continued use of the service after changes take effect constitutes acceptance where permitted by law.
14. General
- These Terms are governed by the laws of England and Wales.
- If you live in England or Wales, disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts where UK law allows.
- If any provision is unenforceable, the rest remains in effect.
- We may assign our rights and obligations; you may not assign without our consent.
- These Terms, together with any order confirmation or service description we provide, form the agreement between you and us.
- A person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
